Welcome to Premier Perspectives!

These terms and conditions govern your use of our comprehensive range of services, including but not limited to photography, videography, drone services, and all associated editing and post-production services, provided by Premier Perspectives. By engaging our services, you agree to abide by these terms. Please read them carefully.

1. Copyright Agreement - Real Estate

The copyright for all materials produced by Premier Perspectives LLC ("Premier Perspectives") remains with Premier Perspectives and is safeguarded under local and international copyright laws. The copyright is non-transferable unless express written permission of copyright is granted by Premier Perspectives. For real estate media, the client (hereafter referred to as "Client") utilizing Premier Perspectives' services is granted permission to use the purchased works for marketing the specified property only, for a period of 12 months from the date of the shoot. Any use of these materials for additional marketing or promotion, such as for a business or individual (including any use by architects, builders, painters, kitchen suppliers, designers, and any print or web publications, or any other third parties), constitutes a violation of copyright. Upon purchasing the services of Premier Perspectives LLC, the Client consents to abide by the terms of this agreement. This copyright clause aims to maintain the cost-effectiveness of real estate listing photography, and any reuse of images from one listing to another without express consent is not permitted by this agreement.

Copyright Disputes and Violations

In the event of any dispute arising out of or in connection with this agreement, the parties shall attempt to resolve the dispute through friendly consultation. If the dispute is not resolved within a period of 90 days, either party may submit the dispute to local competent courts for resolution. If any images or works are used in violation of this agreement, the client agrees to pay a fee per image or work for each instance of misuse, in addition to any legal fees incurred in enforcing this agreement.

Express Consent for Reuse of Images

To obtain express consent for reuse of images, a written request must be submitted to Premier Perspectives LLC detailing the intended use of the images. Consent will be considered on a case-by-case basis and, if granted, may be subject to additional fees. This consent, if granted, will be provided in writing, and only then can the images be used for the purposes stated in the consent.

2. Licensing Agreement - Other Works

Premier Perspectives may create works beyond those specifically for real estate marketing purposes, which may include but are not limited to artistic photography, commercial videography, and other creative endeavors ("Works"). These Works may be licensed to clients for a fee, allowing the client to utilize the Works for their intended purpose. Such licensing agreements for Works shall be governed by separate, written contractual agreements between Premier Perspectives and the Client. These agreements shall outline the terms of the license, including the duration, permitted use, and any additional fees associated with the licensing of the Works. The Client acknowledges that the licensing of Works requires a separate contractual agreement and agrees to adhere to the terms outlined therein.

3. Travel Fees

Properties located within 25 miles of the city limits of Olathe, KS, will not be charged additional travel fees. Properties located outside of 25 miles from Olathe, KS, will be charged an additional mileage fee of $2.50 per additional mile.

4. Drone Disclaimer

Premier Perspectives reserves the right to cancel or refund aerial photos/videos due to unavoidable circumstances such as weather, FAA restrictions, general safety concerns, or any reason deemed necessary by the Pilot In Command during the time of the shoot. Drone services are not guaranteed for any order and will be refunded if the drone pilot is unable to fly.

5. Cancellation Policy

For cancellations made less than 24 hours prior to the scheduled shoot, we will retain the $50 deposit made upon order placement. If the order is cancelled more than 24 hours prior to the appointment, the $50 deposit made upon order placement will be refunded. If the property is not in proper condition for shooting, the appointment will be cancelled, and we will retain the $50 deposit made upon order placement. Cancellations due to extreme weather conditions will not incur any charges.

6. Payment Policy

Payment is due upon delivery of the product (e.g., photos, video, floor plan, etc.). If other payment arrangements need to be made, please notify us with details prior to the scheduled session.

7. Revision Policy

Premier Perspectives provides up to 2 revisions of the final Works at no additional cost to the Client. Any additional revisions beyond the initial 2 will incur an additional fee, which will be communicated to the Client before commencement of the additional revisions.

8. Privacy Policy
